Application
These are the terms on which we sell all goods to you. By ordering any of the goods, you agree to be bound by these Terms and Conditions in a legally enforceable contract.
Goods
The description of the goods is as set out in the website, catalogues, brochures or other form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies in the size and colour of the goods supplied.
All goods which appear on the Website are subject to availability.
We retain and use all information strictly under the Privacy Policy.
We may contact you by using email or other electronic communication methods.
Basis of Sale
The description of the goods in our website does not constitute a contractual offer to sell the goods. When an order has been submitted on the Website, we can reject it for any reason, although we will try to tell you the reason without delay.
The order process is set out on the Website. Each step allows you to check and amend any errors before submitting the order. It is your responsibility to check that you have used the ordering process correctly.
A contract will be formed for the sale of goods ordered only when you receive an email from us confirming the order (order confirmation). You must ensure that the order confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the order placed by you. By placing an order you agree to us giving you confirmation of the Contract by means of an email with all information in it (ie the Order Confirmation). You will receive the Order Confirmation right after you place an order through our website.
No variation of the contract, whether about description of the goods, fees or otherwise, can be made after it has been entered into unless the variation is agreed by the customer and the supplier in writing, which must be specifically expressed via email.
Price and Payment
The price of the goods and any additional delivery or other charges is that set out on the website at the date of the order or such other prices listed are true and accurate. Any changes to stated prices on the website will be evidently visible.
You must pay by submitting your customer payment details with your order to ensure order is processed correctly.
At this point in time we are accepting payment for our products via the Online Bank Transfer or Cash On Delivery method ONLY. No other forms of payment are accepted.
Delivery / Pickup
Delivery / Pickup orders for Bank Transfer :
We will deliver the goods, to the delivery location within 2 business days from payment confirmation or, failing any agreement, without undue delay and, in any event, not more than 7 business days after the day on which the payment is confirmed. (Deliveries will not commence until payment is made in full for product and any / all delivery charges).
For pickup, once you receive order confirmation and full payment has been received to us, it is your duty to set out a pickup time to retrieve your ordered product. Communication will be carried out via email or by contacting you on the mobile number provided on the order form. Once payment has been confirmed, a duration of 7 business days will be set for you to decide on a date / time for pickup, and come retrieve your ordered product from our enterprise location, unless a further timeline is necessary and specifically expressed to us via the aforementioned communication streams. If any date / time for pickup must be changed, it must be informed to us prior to the set date / time via email or mobile contact. Failure to come retrieve your ordered product within the set period of 7 business days provides us the right to decide on a pickup time for you. In such a case, you will be responsible to retrieve the product on the new date / time we have decided upon.
Delivery / Pickup orders for Cash on Delivery (COD) :
If COD option has been chosen for delivery, we will deliver the goods within 2 business days from order confirmation, or failing any agreement, without undue delay and, in any event, not more than 7 business days after the day on which the order has been confirmed. Our delivery personnel will be in contact with you via email or the mobile number provided on the order form, and will NOT be carrying change. It is your responsibility to ensure that you have the exact amount due for payment for the ordered goods. Goods will not be handed over unless exact cash amount has been handed over to our delivery personnel.
If COD option has been chosen for pickup, we will allow the goods to be retrieved within the aforementioned time period of 7 business days from order confirmation, or failing any agreement, without undue delay and, in any event, not more than 14 business days after the day on which the order has been confirmed, based on the conditions stated in the above section. Our pickup personnel will be in contact with you via email or the mobile number provided on the order form, and will NOT be carrying change. It is your responsibility to ensure that you have the exact amount due for payment for the ordered goods. Goods will not be handed over unless exact cash amount has been handed over to our pickup personnel.
Failure of Delivery / Pickup from our side :
In any case, regardless of events beyond our control, if we do not deliver or provide a pickup opportunity for the goods on time, you can (in addition to any other remedies) treat the order at an end if:
- we have refused to deliver the goods, or if delivery on time is essential taking into account all the relevant circumstances at the time the contract was made, or you said to us before the contract was made that delivery on time was essential; or
- after we have failed to deliver / offer pickup on time, you have specified a later period which is appropriate to the circumstances and we have not delivered / offered pickup within that period.
If you treat the contract at an end, we will (in addition to other remedies) promptly return all / any payments made under the contract and provide a full refund.
If you were entitled to treat the contract at an end, but do not do so, you are not prevented from cancelling the order for any goods or rejecting goods that have been delivered and, if you do this, we will (in addition to other remedies) without delay return all / any payments made under the contract for any such cancelled or rejected goods. If the goods have been delivered, you must return them to us or allow us to collect them from you and we will pay the costs of this
Deliveries outside our usual delivery locations :
At the moment, we do not generally deliver to addresses outside the greater Male’ area in The Maldives ( Male’ City, Hulhumale’ Phase 1 & 2, Villimale’ ), for this option, please contact us vie email to setup your order. If the option for deliveries outside of the greater Male’ is required, we can utilise air freight or boat transfer to deliver our products to islands / countries outside of our usual delivery market. We will specify details for the order such as additional payments to the cost of delivery and order details via email or via the mobile number provided on the order form. Once order confirmation email has been sent, we will specify delivery details to you via the aforementioned communication streams to finalise method of delivery and delivery charges.
Collection of goods from Delivery / Pickup
If you or your nominee fail, through no fault of ours, to take delivery of the goods at the delivery location, we may charge the reasonable costs of storing and redelivering them.
The goods will become your responsibility from the completion of delivery or customer collection. You must, if reasonably practicable, examine the goods before accepting them.
Risk and Title
Risk of damage to, or loss of, any goods will pass to you when the goods are delivered to you.
You do not own the goods until we have received payment in full. If full payment is overdue or a step occurs towards your bankruptcy, we can choose, by notice to cancel any delivery and end any right to use the goods still owned by you, in which case you must return them or allow us to collect them.
Cancellations & Exchanges
Cancellations :
You can cancel the order by telling us before or after the goods are handed over to you. If you wish to withdraw or cancel your order before payment has been confirmed and goods have been handed over to you or a nominee, please email our team with a cancellation request along with your unique order number. If no delivery or additional charges have been incurred, then we can offer a full refund to you with no other conditions.
If you wish to cancel the order after payment has been confirmed, and goods have been handed over to you or a nominee, please email us a cancellation request with your unique order number. In such a case, you must return to any of our business premises any and all goods purchased in undamaged condition at your own expense. Then we must without delay refund to you the price for those goods which have been paid for in advance, but we can retain any additional delivery charges which have been incurred in the process.
Right to cancel :
Subject as stated in these Terms and Conditions, you can request to cancel an order within 7 business days without giving any reason. The cancellation period will expire after 7 business days from the day on which you, or a third party, other than the carrier indicated by you, receive the confirmation email for your order.
To exercise the right to cancel, you must inform us of your decision to cancel the order by a clear statement setting out your decision via email.
To meet the cancellation conditions and deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.
Effects of cancellations in the cancellation period :
Except as set out below, if you cancel this contract, we will reimburse to you all payments received from you, excluding the costs of initial delivery if goods have already been handed over to you.
We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary / damaging handling by you (ie. handling the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods). This is because you are liable for that loss and, if that deduction is not made, you must pay us the amount of that loss.
If you have received goods in connection with the order which you have cancelled, you must send back the goods or hand them over to us at without delay and in any event not later than 7 business days from the day on which you communicate to us your cancellation of your order.
The deadline is met if you send back the goods before the period of 14 days has expired, from the day on which you received order confirmation via email. You agree that you will have to bear the cost of returning the goods.
Exchanges :
If you wish to exchange the product you have ordered before payment has been confirmed and goods have been handed over to you or a nominee, please email our team with a exchange request along with your unique order number. We can offer a product exchange at no cost.
If you wish to exchange the product you have ordered after payment has been confirmed and goods have been handed over to you or a nominee, please email our team with a exchange request along with your unique order number. We can offer a product exchange, however if the original product incurred any delivery charges, we reserve the right to retain any / all initial delivery charges.
Right to exchange :
Subject as stated in these Terms and Conditions, you can request to exchange a product within 7 business days without giving any reason. The exchange period will expire after 7 business days from the day on which you, or a third party, other than the carrier indicated by you, receive the confirmation email for your order.
To exercise the right to exchange, you must inform us of your decision to exchange the order by a clear statement setting out your decision via email.
To meet the exchange conditions and deadline, it is sufficient for you to send your communication concerning your exercise of the right to exchange before the exchange period has expired.
For all exchanges, the customer will be required to arrive at our enterprise location to exchange the products, once a date / time has been settled through communication with our team via email or mobile contact.
Effects of exchanges in the exchange period :
If the product you wish to exchange your initial ordered product for is of a different price:
- We will reimburse the change of the price difference if your new selection is of a lower price than the original product.
- You will be required to pay the price difference, if your new selection is of a higher price than the original product.
In any case, exchange of products will occur only once the final price of the product to be exchanged for, has been settled in full.
We may make a deduction from the reimbursement for loss in value of any goods supplied in the process of exchanging, if the loss is the result of unnecessary / damaging handling by you (ie. handling the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.)
